FLSA for Minimum Wage Employees

Under the Fair Labor Standards Act (FLSA), federal law requires employers to pay a minimum wage, regardless of whether a state itself has a minimum wage law. Employers like those in the food service industry can pay less than minimum wage, because tips are used to supplement the hourly wage. Workers that are paid an hourly wage are usually nonexempt from the overtime pay requirements contained in the FLSA. Consequently, employers are required to pay overtime if an employee is asked to work beyond a certain number of hours. This can often cause disputes and lead to abuse on behalf of an employer. Exempt vs. Non-Exempt Workers Under the FLSA
